Introduction to Legal Sciences - History of Legal Systems
Objectives:
1- The study of comparative legal systems enables to identify the content of legal systems in the past, and follow up the various stages of their development until they reached the picture and form in which they currently exist, which would open the way for the formation of a forward-looking view on the future of these systems in light of the approach they follow during their development.
2- The study of comparative legal systems opens the way towards improving national law by benefiting from the experiences of comparative laws, which would consolidate the desired legislative reforms.
3- Comparative law helps to unify solutions and derive the most appropriate ones from them and thus meet the need for harmonization of law between different countries.
4- Harmonization of comparative legal systems is one of the factors for the development of international relations, through the development of rules by each country related to the jurisdiction of its courts and foreign courts when it comes to a dispute with a foreign element.
5- Comparing many laws Synthesis produces a new original law, which is an innovative function of comparative law and is a constructive function more important than its traditional functions.
6- Being able to identify comparative legal systems and compare them with the legal systems applied in Algeria and the extent of their coexistence.
