      طرق الطعن

      عربي:
      هي وسائل وضعت تحت تصرف المتقاضين لتمكينهم من الحصول على إعادة النظر في نزاعاتهم أو تصحيح الأخطاء المرتكبة أثناء سير الإجراءات.

      English:
      They are legal means made available to litigants to allow them to obtain a re-examination of their disputes or to correct errors committed during the course of the proceedings.

      عربي:
      نميز بين:

      • طرق الطعن العادية: المعارضة، الاستئناف.
      • طرق الطعن غير العادية: الطعن بالنقض، اعتراض الغير الخارج عن الخصومة، التماس إعادة النظر.

      English:
      We distinguish between:

      • Ordinary remedies: opposition and appeal.
      • Extraordinary remedies: appeal to the Supreme Court (cassation), third-party opposition, and application for review.

      الإجراءات المدنية والإدارية

      عربي:
      هي مجموعة القواعد التي تنظم سير الدعاوى المدنية والإدارية من البداية إلى النهاية.

      English:
      They are a set of rules governing the conduct of civil and administrative proceedings from beginning to end.

      الإجراءات الجنائية

      عربي:
      هي القواعد التي تنظم إثبات الجرائم والبحث عن مرتكبيها والتحقيق والحكم.

      English:
      They are the rules governing the establishment of crimes, the search for offenders, the investigation of cases, and their judgment.

      محل الالتزام

      عربي:
      هو الشيء أو الأداء الذي يلتزم به المدين.

      English:
      It is the thing or performance that the debtor is obliged to provide.

      التفتيش

      عربي:
      هو البحث في مسكن عن أدلة تدين صاحبه.

      English:
      It is the search of a residence for evidence that may incriminate its occupant.

      الدعوى (القضية)

      عربي:
      نزاع يُعرض على قاضٍ ويتضمن خلافًا في الوقائع أو القانون.

      English:
      A dispute brought before a judge involving a disagreement in facts or law.

      الدعوى القضائية

      عربي:
      هي وسيلة يلجأ بها الشخص إلى القضاء لحماية حقه.

      English:
      It is a legal means by which a person resorts to the court to obtain recognition or protection of a right.

      العقد العرفي

      عربي:
      عقد يحرره ويوقعه الأطراف دون تدخل موثق.

      English:
      A contract drafted and signed by the parties themselves without the intervention of a notary.

      العقد الرسمي

      عربي:
      عقد يحرره موثق وفق القانون وله حجية قوية.

      English:
      A contract drawn up by a public official (notary) in accordance with the law and having strong evidentiary value.
